Terms and Conditions

Agreeing to these terms
These terms cover your use of the Groundbreak Port Angeles Concrete website, starting with our home page, and any estimate or concrete work you get from us. By using the site, asking for an estimate or booking a job, you agree to them.
If the signed estimate or contract for your job says something different from these terms, the document for your job controls.
What we do
We're a concrete contractor in Port Angeles, WA. We pour flatwork like driveways, patios, sidewalks and garage floors, and we also build steps, retaining walls, footings and foundations for homes in Port Angeles, Sequim and the cities around them. You can read more about who we are on our about page.
The service descriptions on this site are general. The exact scope of your job, including slab thickness, finish and materials, is whatever your written estimate lists.
Estimates and pricing
Estimates are free, done in person, and come with no pressure to book. We need to see the site, the grade and where the water runs before we can price a slab.
An estimate is based on what we can see that day. If we find something once the old concrete is out, like soft or wet subgrade, which is the soil the slab sits on, or buried debris or roots, we'll stop and show you. We'll agree with you on any change in price before we do the extra work.
An estimate stays good for the period written on it. After that, material and labor costs can change, so we may need to update the price.
Scheduling, weather and cancellation
We set pour dates around the weather, because rain, freezing temperatures or hard heat on pour day can leave a weak surface. If conditions aren't right, we'll reschedule and tell you as early as we can. A weather delay isn't a breach of this agreement.
If you need to cancel or move your date, call us at (564) 203-7120 or reach us through our contact page as soon as you know. If we've already ordered concrete, forms or rebar for your job, or the crew is already on site, you may owe the costs we can't get back. Rebar is the steel that reinforces the slab.
Your part of the job
You're responsible for telling us about anything buried that we can't see, like sprinkler lines, private utility lines, septic parts or drain pipes. You also need to make sure trucks and equipment can reach the work area and that the work stays on your property.
Fresh concrete needs time to cure, the slow hardening that gives it strength. You agree to keep people, pets and vehicles off the slab for the times we give you. Damage from using the slab before then isn't covered.
Payment
Payment terms are written on your estimate or contract, including any deposit and when the balance is due. Unless that document says otherwise, the balance is due when the work is done.
If a payment is late, we may pause work until it's paid. We keep any rights Washington law gives contractors to be paid for their work and materials, and you'll be responsible for reasonable collection costs where the law allows it.
Our guarantee and what it doesn't cover
Every job comes with our satisfaction guarantee. If something isn't right, call us. We'll come look at it and work with you to fix it.
Concrete can crack even when it's poured right, because it shrinks as it dries and the ground moves with the seasons. We cut control joints, which are planned grooves that give cracks a place to form, so most cracks land where we chose. We can't promise a slab will never crack. Hairline cracks, slight color differences between pours, and surface wear from salt, chemicals or loads the slab wasn't built for aren't defects.
Your written contract covers what we promise. Beyond that, our work and this website come without other warranties, to the extent Washington law allows.
Limits on our liability
We're licensed and insured, and we're responsible for the work we agree to do. We aren't responsible for damage caused by things outside our control. That includes settling of soil we didn't prepare, flooding, tree roots, earthquakes, and changes someone else makes after we finish.
To the extent the law allows, our total liability for any claim tied to a job is limited to what you paid us for that job. We aren't liable for indirect or consequential losses.
The information on this website is general. It isn't engineering advice for your property.
Settling a disagreement
If you're unhappy, tell us first. Most problems get sorted out on site once we can see them.
If we can't work it out together, we both agree to try mediation in good faith before going to court. If mediation doesn't settle it, the dispute goes to the courts serving Clallam County, Washington.
Which law applies
These terms and any work we do are governed by the laws of the State of Washington.
If a court finds any part of these terms unenforceable, the rest still applies.
Changes to these terms
We may update these terms from time to time. The version posted here applies from the date it's posted, but a change won't alter a signed contract for a job we've already agreed on.
If you have questions about these terms, call us at (564) 203-7120.
